Welcome to EmuDevs (“EmuDevs”, “we”, “our”, “us”). These Terms of Service (“Terms”) govern your access to and use of emudevs.gg, including any content, features, services, and products offered through the platform (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.
If you do not agree, you must not use EmuDevs.
1. Eligibility & Accounts
Account Creation: To use certain features of EmuDevs, you must create an account. You agree to provide accurate and up-to-date information.
Age Restrictions: The Service is not intended for children under the age required by applicable law to consent to data processing; users under such age may not create an account.
Account Security: You are responsible for maintaining the confidentiality of your login credentials.
Account Termination: We reserve the right to suspend or terminate accounts for violations of these Terms, the User Agreement, or the Community Guidelines.
2. Description of the Service
EmuDevs is a social platform and file-sharing service that allows users to upload, store, share, and interact with various forms of content. Some features may require a paid subscription.
3. Subscriptions & Payments
Pro Membership: EmuDevs offers an optional paid upgrade (“Pro”) that provides additional features.
Billing: Pro subscriptions are recurring and billed through Stripe or other listed payment providers.
Refunds: You may request a refund within 14 days of purchase. After that period, purchases are non-refundable unless required by law.
Cancellation: You may cancel your subscription at any time; access remains until the end of the billing cycle.
4. User Content
Your Content: You may upload and share files, posts, and other materials (“User Content”).
License to Us: By uploading User Content, you grant EmuDevs a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute it as needed to operate the Service.
Your Responsibilities: You are responsible for ensuring that your content does not violate any laws, these Terms, the User Agreement, or the Community Guidelines.
Content Removal: We may remove or restrict content that violates policies or poses a risk to users or the platform.
Uploader Responsibility & Indemnification
By uploading any content to EmuDevs, you acknowledge and agree that:
You are solely responsible for the content you upload, publish, or distribute
You assume all legal risks associated with your uploads
You are responsible for ensuring compliance with applicable copyright, intellectual property, and other laws
You agree to indemnify, defend, and hold harmless EmuDevs, its operators, and affiliates from any claims, damages, losses, liabilities, legal fees, or expenses arising from:
Content you upload
Downloads or use of your uploaded content
Alleged infringement or legal violations related to your uploads
Hosting Provider & Neutral Platform Status
EmuDevs operates solely as a technical hosting provider for user-generated content.
EmuDevs does not pre-screen uploads
EmuDevs does not verify ownership, licensing, or legality of user-uploaded content
EmuDevs does not endorse, promote, or curate user-uploaded materials
All content is made available “as uploaded by users”.
No Endorsement of Content
The presence of any content on EmuDevs does not imply:
Approval
Authorization
Ownership
Endorsement
by EmuDevs or its operators.
5. Right to Remove Content
EmuDevs reserves the right to:
Remove or disable access to any content
Comply with legal requests or court orders
Act against repeat complaints or abuse
This may occur without prior notice.
6. Acceptable Use
You agree not to use EmuDevs for:
Scraping, crawling, or collecting data without permission
Spamming, phishing, or distributing malware
Uploading or sharing illegal content
Attempting to DDoS, interfere with, or disrupt the platform
Any activity that violates German law or the rights of others
Violation may result in removal of content, account suspension, or legal action.
7. Intellectual Property
All trademarks, branding, logos, and content created by EmuDevs are owned by us and protected by applicable laws. Users retain ownership of their own content subject to the license granted to EmuDevs above.
8. Third-Party Services
EmuDevs integrates with third-party services such as:
Stripe (payments)
Discord (authentication and integration)
Google (authentication)
Spotify (authentication and playback components)
Your use of these features may also be governed by the third party's terms and privacy policies. EmuDevs is not responsible for their actions or services.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted service, error-free functionality, or the accuracy of any content.
Your use of EmuDevs is at your own risk.
10. Limitation of Liability
To the fullest extent permitted by law:
EmuDevs shall not be liable for indirect, incidental, or consequential damages.
Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the previous 12 months (if any).
Nothing in these Terms affects rights that cannot be limited under German law.
11. Governing Law
These Terms are governed by the laws of Germany, without regard to conflict-of-law principles.
12. Modifications to the Service or Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top. Continued use of the Service after changes means you accept the updated Terms.
